Maria Sabir was five months pregnant when the horrific accident happened in Green Lane, Ilford, in April 2010.

A judge has now ruled that the driver was largely to blame for the incident.

The 32-year-old, of Levett Gardens, Seven Kings, sustained multiple injuries, including a traumatic brain injury, fractured skull and other broken bones, and also suffered a miscarriage as a result of the crash.

Through her husband, Muhammad Irfan, she sued driver Nana Osei-Kwabena, of Barnes House, St Mary’s, Barking, for damages.

Judge William Davis QC ruled that Mr Osei-Kwabena bore the lion’s share of responsibility for the accident.

The exact amount of compensation Mrs Sabir will receive has not yet been assessed, but such cases often involve payouts worth millions of pounds.

During a brief High Court hearing last week, the judge heard that Mrs Sabir had parked her Saab in Green Lane and was crossing the road from behind it when she was hit by a Ford Focus, driven by Mr Osei-Kwabena.

Mrs Sabir’s lawyers argued that the collision was caused by negligence.

They alleged that the driver failed to keep a proper lookout on the road ahead and drove too fast in the circumstances.

Lawyers for Mr Osei-Kwabena said that he should bear no responsibility for the crash, as Mrs Sabir may have made an error of judgment when crossing the road.

But the judge ruled that the driver’s liability for the crash was 75 per cent.

Court documents revealed that, as well as losing her baby, Mrs Sabir has been left with significantly impaired memory and speech.

She needs constant supervision and will never be able to work again.
